The Robe Squad: How Foreign-Born Judges Are Running Interference for Open Borders
Newmax's Carl Higbie argues that the border fight isn't only happening at the border. It is happening in courtrooms, where a single judge can put the brakes on immigration enforcement faster than a Delaware driver spotting a state trooper on Route 1.
That is the heart of Higbie’s recent criticism on Newsmax. He says certain liberal judges are helping block the enforcement agenda voters expected, while Democrats wrap it all in the soft blanket of “judicial independence.” Funny how the blanket always seems to cover the same side of the bed.

The courtroom has become a border checkpoint.
Immigration policy used to be argued mostly in Congress, at the White House, and along the southern border. Now, major fights land before federal judges.
That part is not imaginary. Courts have played a huge role in immigration fights under both parties. Judges blocked or limited parts of Trump-era border policies. Judges also blocked or limited Biden-era immigration actions when states challenged them.
The difference is that conservatives see a pattern. When an elected Republican tries to tighten enforcement, lawsuits fly, and certain judges seem ready with a stop sign the size of Texas.
Higbie’s point is that judges should apply the law, not rewrite it from the bench. That is not a fringe idea. The Constitution gives Congress the job of writing immigration law. The president enforces it. Courts decide legal disputes. When judges start acting like unelected border czars, people notice.
Democrats suddenly love the courts when the courts agree.
Democrats often defend these rulings as proof of judicial independence. That defense gets thinner when the same crowd calls for court changes when rulings go the other way.
Many Democratic lawmakers have supported expanding the Supreme Court. That means adding more justices, which critics call court-packing. The goal is not subtle. Add enough friendly votes, and the Court starts producing the “correct” outcomes. Very humble. Very neutral. Very “we only changed the scoreboard after losing.”
This is why the phrase Carl Higbie Says Judges Are Shielding Open Borders lands with many conservatives. It speaks to a real concern: Democrats don't just want to win elections. They want guardrails in place for when they lose them.
The foreign-born judge claim needs care.
Higbie has also raised questions about some judges' backgrounds, including whether they were born outside the United States. That claim should be checked case by case before anyone starts making sweeping claims.
Birthplace alone does not prove a judge is biased. A foreign-born American can understand the Constitution just fine. Plenty of native-born officials treat it like a restaurant napkin.
The better question is this: Does the ruling follow the law as written? If not, the judge’s biography isn't the main issue. The ruling is.
That is where the focus belongs. Names, cases, orders, and legal reasoning matter more than slogans.

The rule of law cannot be a one-way street.
The border was not “secure” just because officials repeated the line on television. Americans watched record pressure at the border, overwhelmed towns, and endless fights over enforcement.
So when the same political class lectures everyone about the rule of law, people have a right to ask whether that rule applies to judges too.
Higbie’s warning is worth taking seriously. Not blindly. Not with bumper-sticker logic. Check the cases. Read what the judges actually ruled. Then ask the basic question: did they interpret the law, or did they steer policy from the bench?
If judges block lawful enforcement because they dislike the policy, that isn’t independence. That is politics in a robe. And the robe does not make it any prettier.
